Terms of Service
Last updated: April 9, 2026
Scope of service
OPS is a managed operations layer for live websites and client projects. Depending on your plan and configuration, the service may include branded administrative access, operations dashboards, managed infrastructure integration, content and media workflows, analytics views, AI-assisted tools, and related onboarding or support. Specific features and limits depend on the plan, agreement, or order form that applies to you.
Accounts and access
You are responsible for safeguarding account credentials and for activity under your account. You must provide accurate information and keep billing and contact details current where required.
We may suspend, limit, or revoke access for misuse, non-payment, suspected abuse, security concerns, violation of these terms, or to protect the integrity of the platform or other customers. We may also restrict access while investigating issues.
Acceptable use
You agree not to misuse OPS. For example, you must not:
- Probe, disrupt, or attempt unauthorized access to systems, data, or accounts
- Use the service to distribute malware, unlawful content, or content you do not have rights to use
- Interfere with other customers' use of the service or place unreasonable load on the platform
- Use AI features to generate unlawful, deceptive, or harmful outputs, or to circumvent safeguards
- Use the service in a way that creates undue legal, security, or operational risk
We may investigate and respond to violations, including suspension or termination.
Plans, billing, and renewals
Paid plans are generally billed in advance on a recurring basis unless your agreement states otherwise. Fees depend on the plan, scope, or custom arrangement. Subscriptions may renew automatically until cancelled where that renewal model applies.
You are responsible for timely payment and accurate billing information. If payment fails or is overdue, we may suspend or downgrade paid features, restrict access, or take other reasonable collection steps described in your order or account notices.
Refunds
Fees are generally non-refundable once a billing period has started. We do not provide refunds for partial periods, unused time, or subjective dissatisfaction, except where required by law or where we explicitly offer a different policy in writing for a specific promotion or plan.
Setup, onboarding, configuration, migration, or bespoke implementation work is typically non-refundable once that work has begun or been delivered, unless your written agreement with OPS says otherwise.
Changes, cancellations, and downgrades
You may cancel future renewals through the billing controls we provide or as described in your agreement. Cancelling future renewals does not automatically refund the current period. Downgrades or plan changes may reduce feature access immediately or at the next renewal, as stated at the time of change.
We may change pricing, plans, or feature packaging in the future. Where required, we will provide reasonable advance notice. Continued use after changes may constitute acceptance of updated fees or terms as described in those notices.
Service availability
We aim to keep OPS available and reliable, but we do not guarantee uninterrupted or error-free access. The service may experience maintenance, updates, outages, or dependency failures outside our full control. We may change, improve, suspend, or discontinue features or the service in whole or in part.
Third-party infrastructure
OPS relies on third-party providers for infrastructure, hosting, security, payments, analytics, AI, and related functions. We are not responsible for outages, errors, or acts of those providers beyond what we can reasonably influence, though we work to operate a dependable service on top of them.
Your content and responsibility
You remain responsible for the legality, accuracy, and rights clearance of content, media, data, and materials you or your end users submit or manage through OPS. You grant OPS the limited rights needed to host, process, and display that material to provide the service you purchased.
Intellectual property
OPS retains rights in the platform, software, branding, and related materials. Your content stays yours (or your client's) subject to the rights you grant us to operate the service. Subject to these terms and your plan, we grant you a limited, non-exclusive right to access and use OPS for your internal business purposes during your subscription.
AI-assisted features
Some features may use AI to suggest content, structures, workflows, or other outputs. AI can be wrong, incomplete, or unsuitable for your situation. You are responsible for reviewing outputs before relying on them or publishing them. OPS does not guarantee that AI outputs are accurate, complete, lawful, or fit for a particular purpose.
Limitation of liability
To the maximum extent permitted by law, OPS and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, or data, arising from or related to the service, even if advised of the possibility.
Except where prohibited by law, OPS's total liability for any claim arising out of or relating to the service is limited to the greater of the amount you paid OPS for the service in the three (3) months before the event giving rise to the claim, or fifty U.S. dollars (USD $50). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
Disclaimer of warranties
The service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Termination
We may suspend or terminate access for breach, non-payment, abuse, legal risk, or to protect security or the service. You may stop using OPS at any time. Provisions that by their nature should survive termination (including payment obligations, disclaimers, limitations, and indemnity-related concepts where applicable) will survive.
Changes to these terms
We may update these terms from time to time. We will post the updated version on this page and update the "Last updated" date. If changes are material, we may provide additional notice through the service or by email. Continued use after the effective date may constitute acceptance of the revised terms.
